BahariHost is a web hosting and cloud infrastructure service operated by Datacorelink. This page provides the legal and operational information applicable to BahariHost websites, client accounts, orders, payments, support requests, and services.

By creating an account, placing an order, paying an invoice, or using a BahariHost service, you agree to the terms and policies described on this page and any product-specific conditions displayed during checkout.

2. Services covered

This Legal Information applies to services supplied by BahariHost, including:

  • Shared, WordPress, business, and reseller hosting
  • BDIX VPS, cloud VPS, Linux VPS, and Windows RDP
  • Dedicated servers, bare metal, and colocation
  • Domain registration, renewal, transfer, and restoration
  • SSL certificates, software licenses, dedicated IPs, backups, migrations, addons, and managed or professional services

The specifications, billing cycle, resource limits, location, bandwidth, renewal price, and included features shown on the relevant order page form part of the service agreement.

3. Account and verification

Customers must provide accurate and current identity, contact, billing, and ownership information. BahariHost may request additional verification before or after activation to prevent fraud, abuse, unauthorized payments, or unlawful use.

NID verification is mandatory for BDIX VPS/RDP orders where stated. BahariHost may delay, reject, restrict, or cancel an order if the supplied information is incomplete, inconsistent, unverifiable, or presents a security or compliance risk.

Customers are responsible for protecting their passwords, private keys, API keys, control panels, registered email addresses, and devices. All activity performed through a customer account, reseller account, subaccount, VPS, or hosted service remains the responsibility of the account holder.

4. Orders and service activation

Submitting or paying for an order does not guarantee acceptance. An order is accepted when BahariHost provisions the service or confirms acceptance. Some orders may require payment confirmation, stock availability, identity verification, fraud review, licensing, or manual activation.

Statements such as “instant activation” describe the normal automated process and are not a guarantee that every order will be activated immediately. If BahariHost cannot supply a paid service, the customer may be offered an equivalent service, account credit, or a refund of the unavailable item.

5. Pricing, offers, and renewal

The amount shown on the final checkout page and invoice is the applicable price for that billing term. Customers must review the selected product, billing cycle, promotional price, renewal price, taxes, and additional fees before payment.

Promotional prices apply only for the period stated in the offer. For example, a 50% first-month VPS offer applies only to the first monthly invoice. From the second month, the service renews at the regular product price displayed during checkout. The promotion allows customers to test the VPS at a lower initial cost and does not create a permanent discounted renewal price.

Future renewal prices may change because of infrastructure, registry, licensing, tax, exchange-rate, payment-provider, or supplier costs. Where reasonably possible, updated pricing will be displayed or notified before the affected renewal. Customers may cancel before renewal if they do not accept the new price.

An obvious technical, typographical, calculation, or display error, including an incorrect ৳0 price, is not binding. BahariHost will disclose the correct price and allow the customer to continue or cancel before provisioning.

6. Payments and invoices

Invoices must be paid by the due date shown. A payment is considered complete after it has been verified and applied to the invoice. Bank, card, mobile financial service, or payment-gateway processing may delay confirmation.

Unpaid or expired services may be restricted, suspended, terminated, or deleted according to the product type and applicable grace period. Restoration is not guaranteed and may require payment of outstanding invoices, renewal, reactivation, redemption, administrative, or third-party charges.

Customers should contact the Billing Team before initiating a chargeback or payment dispute. BahariHost may suspend related services while an unauthorized or abusive chargeback is investigated, without limiting any lawful right to dispute a payment.

7. Refund and cancellation

Refund approval is not automatic. Eligibility depends on the product, billing cycle, activation date, usage, payment status, support history, and reason for cancellation.

The standard refund conditions are:

  • Domain registration, renewal, transfer, redemption, premium domain, and registry fees are non-refundable once submitted
  • Eligible monthly shared, WordPress, or business hosting may be reviewed within 30 days of activation, with any approved amount calculated for unused time after applicable deductions
  • Monthly reseller hosting may be reviewed within 72 hours of activation
  • Monthly VPS, cloud VPS, RDP, or virtual servers may be reviewed within 3 days of activation after reasonable troubleshooting
  • Semi-annual, annual, biennial, triennial, or other long-term hosting, reseller, VPS, and RDP plans are generally non-refundable
  • Dedicated servers, bare metal, colocation, SSL certificates, licenses, IP addresses, addons, setup, migration, backup services, and completed or started professional work are generally non-refundable

A valid request requires the customer to submit a cancellation request through the authenticated Client Portal and notify the Billing Team with the cancellation or ticket reference. Cancellation does not automatically mean a refund has been approved.

Approved refunds may exclude used service time, payment-gateway charges, bank or mobile-financial-service fees, taxes, currency conversion, registry costs, licenses, IPs, setup, migration, completed work, and other non-recoverable third-party expenses. Mandatory customer rights under applicable law remain unaffected.

Customers must download all required data before cancellation. Cancellation, expiry, suspension, or termination may make data unavailable and may lead to deletion.

8. Service availability and support

BahariHost works to maintain reliable infrastructure, but no internet or hosting service can be guaranteed to operate without interruption. A service-specific uptime commitment applies only where the relevant product page or written agreement expressly states an SLA.

Website errors caused by customer code, plugins, themes, malware, DNS configuration, exceeded resources, third-party APIs, external networks, local ISPs, unsupported software, or customer actions are not treated as BahariHost infrastructure downtime.

Scheduled or emergency maintenance, attacks, DDoS mitigation, upstream network failure, data-center events, registry issues, force majeure, policy suspension, and circumstances outside BahariHost's reasonable control may be excluded from uptime calculations.

“24/7 support” means support channels are monitored throughout the week. Any advertised response time is a target rather than a guaranteed resolution time. Complex, security-related, upstream, migration, recovery, or third-party issues may require additional time.

9. BDIX VPS and RDP conditions

BDIX identifies the service as focused on local peering and connectivity. It does not guarantee identical speed, latency, route quality, or reachability to every ISP, network, international destination, or third-party service. International bandwidth, transfer limits, port speed, and routes depend on the selected package.

Windows RDP requires the minimum CPU, RAM, storage, and licensing stated on the product page. Customers must select a suitable plan before ordering. VPS/RDP customers are responsible for operating-system updates, firewall rules, SSH/RDP security, passwords, installed applications, and data unless a managed service has been purchased.

CPU cores may be virtual or shared unless explicitly described as dedicated. Storage shown inside an operating system may differ slightly because of formatting, filesystem metadata, and reserved space.

10. Domains

A domain availability result or order does not reserve the name. Registration is complete only after confirmation from the applicable registrar or registry.

Customers must verify the spelling, extension, registrant information, price, and legal rights to a domain before payment. Completed domain registrations, renewals, transfers, restores, redemptions, and registry transactions cannot normally be reversed or refunded.

A free domain offer applies only to eligible plans and extensions for the stated initial period. Unless expressly stated otherwise, the customer is responsible for the domain's regular renewal fee after the free period.

WHOIS privacy is provided only where supported by the domain extension, registrar, registry, and applicable law. It does not prevent required disclosure to registrars, registries, dispute-resolution providers, or lawful authorities.

Customers are responsible for renewing domains and maintaining valid registrant contact information. Expired domains may stop resolving, enter redemption, incur additional charges, be auctioned, deleted, or registered by another person. Recovery is not guaranteed.

11. Resource usage and fair use

Shared hosting resources are shared among customers. CPU, RAM, disk I/O, storage, inode, database, process, email, bandwidth, and connection limits may be enforced according to the selected plan.

“Unlimited” or “unmetered” does not mean infinite resources. It means normal website usage is not billed by each unit, subject to the package's technical limits and fair use. Usage that materially affects server stability, other customers, the network, or upstream providers may be limited, isolated, suspended, or required to move to a more suitable plan.

12. Acceptable use

BahariHost services must not be used for unlawful, fraudulent, deceptive, abusive, or harmful activity. Prohibited uses include:

  • Phishing, impersonation, credential theft, payment fraud, scams, or counterfeit documents
  • Malware, ransomware, spyware, botnets, exploit kits, or command-and-control systems
  • DDoS attacks, unauthorized scanning, brute-force attacks, traffic amplification, spoofing, or network disruption
  • Spam, unsolicited bulk messaging, harvested mailing lists, forged headers, open relays, or mail bombing
  • Child sexual abuse material, sexual exploitation of minors, trafficking, or related content
  • Stolen accounts, personal data, payment information, illegal goods, or unlawful services
  • Copyright, trademark, privacy, or other rights infringement
  • Harassment, doxxing, credible threats, or non-consensual intimate content
  • Attempts to bypass security, verification, product limits, suspension, monitoring, or these conditions
  • Resource usage that materially harms the server, network, upstream provider, or other customers

BahariHost may warn, request correction, filter, rate-limit, isolate, suspend, disable content, terminate a service, preserve relevant evidence, or contact an upstream provider or lawful authority. Active phishing, malware, attacks, severe fraud, child sexual abuse material, or an immediate security threat may result in action without advance notice.

13. Backups and customer data

Unless a paid backup product or written agreement states otherwise, included backups are a best-effort operational convenience and not a guarantee. An advertised daily backup schedule does not guarantee that every file, database, mailbox, VPS disk, or recovery point will always be complete, current, restorable, or retained for a specific period.

Customers must maintain independent and tested off-site backups. Backup jobs or restoration may fail because of corruption, malware, quota, exclusions, software failure, customer configuration, infrastructure failure, or data deletion. Restoration may be unavailable, limited, delayed, or chargeable.

14. Privacy and data use

BahariHost may collect account details, contact information, billing and transaction records, domain-registration data, support communications, IP addresses, login records, server and network logs, security events, resource usage, and Customer Content required to supply and protect services.

Information may be processed by necessary service providers, including data centers, network providers, domain registrars and registries, payment gateways, banks, email or communication services, security providers, backup providers, and professional advisers. BahariHost does not sell or rent personal information.

Customer Content may be accessed only when reasonably necessary to provide requested support, maintain or secure the service, investigate abuse, restore data, enforce agreements, or comply with applicable law or valid legal process.

Information is retained only as reasonably required for service delivery, billing, accounting, fraud prevention, security, disputes, registry obligations, and legal compliance. Customers may request access, correction, or deletion of eligible personal information through Support, subject to identity verification and lawful retention requirements.

15. Cookies

BahariHost websites and the Client Portal use necessary cookies for login, session security, forms, shopping carts, checkout, language, preferences, and fraud prevention. Analytics or performance cookies may be used to understand website use and improve services. Blocking necessary cookies may prevent core features from working correctly.

Third-party payment, support, security, communication, or embedded services may use their own cookies under their respective policies.

16. Suspension and termination

BahariHost may suspend or terminate a service for non-payment, false or unverifiable information, prohibited use, repeated abuse, security risk, chargeback, legal requirement, or a material breach of these conditions.

Where reasonable and safe, the customer may be given an opportunity to correct the issue. Severe, repeated, deceptive, unlawful, or actively harmful conduct may result in immediate action without refund. Suspension or termination may make data inaccessible, and post-termination recovery is not guaranteed.

17. Warranty and liability

Services are provided on an “as available” basis to the extent permitted by law. BahariHost does not guarantee uninterrupted operation, compatibility with every application, universal network reachability, email inbox placement, search ranking, IP reputation, prevention of every attack, business profit, customer traffic, or recovery of all data.

To the extent permitted by law, BahariHost and Datacorelink are not responsible for indirect, incidental, special, punitive, or consequential loss, including lost profit, revenue, opportunity, reputation, business, or data.

For a claim directly caused by BahariHost, total liability is limited to the amount paid for the affected service during the three months immediately preceding the event, or any higher amount required by applicable law. Nothing on this page excludes liability or customer rights that cannot legally be excluded.

18. Changes to legal terms

BahariHost may update this page to reflect changes in services, suppliers, security requirements, business practices, or applicable law. The updated version will be published with a revised date. Material changes may also be notified through email, the Client Portal, or another appropriate channel.

Continued use or renewal after the effective date constitutes acceptance of the updated terms, except where additional consent is required by law.

19. Governing law and disputes

These terms are governed by the applicable laws of Bangladesh. Customers should first contact BahariHost Support or Billing with the relevant service, invoice, ticket, timestamps, and evidence so the matter can be investigated.

If a dispute cannot be resolved directly, it may be submitted to a court of competent jurisdiction in Dhaka, Bangladesh, unless mandatory law requires a different forum. This does not prevent a lawful complaint to a regulator, payment provider, or competent authority.
