Welcome to BahariHost, a hosting and infrastructure service brand operated by Datacorelink.

These Terms and Conditions (“Terms”) govern your registration, purchase, access to, and use of BahariHost websites, client portals, hosting accounts, virtual servers, dedicated servers, domain-related services, software, licenses, support services, and associated products.

By creating an account, placing an order, making a payment, renewing a service, or continuing to use any BahariHost service, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, you must not purchase or use our services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into an agreement to purchase or use BahariHost services.

If you are under 18, a parent or legal guardian must register, purchase, and manage the service on your behalf.

If you purchase a service for a company, organization, client, or another person, you confirm that you have the authority to accept these Terms on their behalf.

2. Account Registration

You must provide accurate, complete, and current information when creating an account or placing an order.

This may include your:

  • Full name
  • Email address
  • Phone number
  • Billing address
  • Business information
  • Payment information
  • Identity-verification information

BahariHost may request additional information or documents for fraud prevention, payment verification, abuse investigation, or legal compliance.

We may reject, suspend, or terminate accounts containing false, incomplete, misleading, impersonated, or unverifiable information.

3. Account Security

You are responsible for securing your BahariHost account, client portal, websites, servers, applications, databases, and login credentials.

You must:

  • Use secure and unique passwords
  • Enable two-factor authentication where available
  • Keep your contact information updated
  • Restrict access to authorized persons
  • Protect API keys, passwords, and access tokens
  • Notify BahariHost immediately if unauthorized access is suspected

All activities performed through your account will be treated as authorized by you unless you notify BahariHost of a security incident.

BahariHost is not responsible for damage caused by credential sharing, weak passwords, outdated software, insecure applications, customer misconfiguration, or failure to secure an account.

4. Orders and Service Activation

Services are activated after successful payment and, where required, payment or identity verification.

Activation times displayed on the website are estimates. Activation may be delayed due to:

  • Manual verification
  • Fraud screening
  • Resource or stock availability
  • Data-center provisioning
  • Software licensing
  • Custom configuration
  • Incorrect customer information
  • Third-party service delays

BahariHost may accept, reject, cancel, or manually review an order where fraud, abuse, incorrect pricing, resource unavailability, or policy violations are suspected.

Submitting an order does not guarantee that BahariHost will accept or activate it.

5. Service Information and Pricing

Customers are responsible for reviewing the product description, specifications, billing cycle, resource limits, location, management level, and applicable conditions before purchasing.

BahariHost may change prices due to:

  • Currency exchange rates
  • Supplier costs
  • Data-center charges
  • Licensing fees
  • Tax or regulatory requirements
  • Infrastructure upgrades
  • Business requirements

Unless otherwise stated, price changes apply to new purchases and future renewals.

If an incorrect price or product specification is displayed due to a technical or human error, BahariHost may cancel the affected order or offer the customer the correct product and price.

6. Payments and Billing

All services must be paid for in advance unless BahariHost has provided a separate written agreement.

Customers are responsible for:

  • Reviewing their invoices
  • Paying invoices before the due date
  • Using an authorized payment method
  • Providing correct transaction information
  • Paying applicable gateway, transaction, or administrative fees
  • Renewing services before expiration

A payment screenshot, transaction reference, or payment claim does not constitute confirmed payment until BahariHost verifies that the funds have been received.

BahariHost may delay activation or renewal while a payment is being reviewed.

7. Renewal and Expiration

Customers are solely responsible for renewing their services on time.

BahariHost may send renewal reminders as a convenience. Failure to receive a reminder does not remove the customer's responsibility to renew.

If a service is not renewed:

  • The service may expire or be suspended
  • Websites and applications may become unavailable
  • IP addresses or licenses may be reassigned
  • Data may be scheduled for permanent deletion
  • Recovery may require payment of outstanding charges
  • Recovery or restoration fees may apply
  • Restoration may not always be possible

Service expiration does not guarantee that customer data will remain available.

8. Acceptable Use

BahariHost services may only be used for lawful and authorized purposes.

Customers are responsible for all content, files, websites, applications, databases, users, traffic, communications, and activities associated with their services.

This responsibility also includes activities performed by:

  • Employees
  • Developers
  • Administrators
  • Customers
  • Resellers
  • Contractors
  • Anyone with access to the customer's account or service

Customers must comply with applicable Bangladesh law, data-center rules, network-provider requirements, and any laws applicable to the location where the service is operated.

9. Prohibited Content and Activities

Customers must not use BahariHost services to host, publish, distribute, promote, facilitate, or participate in illegal, harmful, fraudulent, abusive, or unauthorized activities.

9.1 Illegal and Harmful Content

The following are strictly prohibited:

  • Content prohibited under applicable law
  • Child sexual abuse or exploitation material
  • Non-consensual intimate content
  • Human trafficking or exploitation
  • Terrorist propaganda or recruitment
  • Content encouraging serious violence or criminal activity
  • Fraudulent documents or counterfeit products
  • Identity theft or impersonation
  • Unlawful harassment or threats
  • Content that unlawfully violates another person's privacy
  • Stolen, leaked, or unlawfully obtained personal information

9.2 Gambling and Betting

Customers must not operate, host, promote, or provide technical infrastructure for:

  • Online gambling
  • Betting or wagering platforms
  • Casino or slot platforms
  • Unauthorized lottery systems
  • Gambling payment processing
  • Gambling affiliate systems
  • Applications designed to facilitate prohibited betting or wagering

BahariHost may immediately suspend services connected to gambling or betting activities.

9.3 VPN, Proxy, and Traffic Relay Services

Public or commercial VPN, proxy, tunnelling, traffic-relay, or IP-masking services are prohibited unless BahariHost has provided prior written approval.

Prohibited services include:

  • Public VPN services
  • Open proxies
  • Residential proxy networks
  • IP-rotation services
  • Traffic-reselling services
  • Unauthorized tunnelling
  • Services intended to conceal abuse or bypass lawful restrictions

Private business VPN use may be considered only with prior written approval.

9.4 Game Hosting

The following are not permitted on standard BahariHost plans unless the purchased package is specifically designed for game hosting or prior written approval has been obtained:

  • Public game servers
  • Game-hosting panels
  • Game-server reselling
  • Game-hosting nodes
  • Services primarily designed to host multiplayer games

Unauthorized game hosting may be suspended where it creates DDoS exposure, licensing concerns, excessive resource usage, network abuse, or infrastructure instability.

9.5 Cybercrime and Malicious Activity

Customers must not use BahariHost services for:

  • Malware, ransomware, spyware, viruses, or trojans
  • Botnets or command-and-control servers
  • Phishing or credential theft
  • Carding or financial fraud
  • Unauthorized vulnerability scanning
  • Brute-force attacks
  • Credential stuffing
  • Password cracking
  • DDoS attacks
  • Unauthorized stress testing
  • Exploit distribution
  • Unauthorized access to systems or accounts
  • Hosting or distributing stolen data
  • Circumventing security protections
  • Activities intended to compromise another system

Authorized penetration testing requires prior written approval from BahariHost and documented authorization from the lawful owner of the target system.

9.6 Email and Spam Abuse

Customers must not use BahariHost services to send:

  • Unsolicited bulk email
  • Emails to purchased or scraped mailing lists
  • Phishing or fraudulent messages
  • Messages with forged sender information
  • Malware or harmful attachments
  • Excessive email that damages network reputation

Customers operating mailing lists must maintain proper consent, unsubscribe procedures, and appropriate SPF, DKIM, and DMARC records.

BahariHost may restrict email ports, suspend email services, or terminate accounts involved in spam or repeated mail abuse.

9.7 Intellectual Property Violations

Customers must not knowingly host or distribute content that unlawfully infringes copyrights, trademarks, software licenses, or other intellectual-property rights.

A service advertised as offshore or “DMCA Ignored” does not permit illegal content. All services remain subject to applicable local law, data-center rules, network-provider requirements, and valid legal orders.

BahariHost may investigate complaints and restrict or remove content where legally required.

10. Resource Usage

Customers must use allocated resources responsibly.

The following activities are prohibited when they negatively affect infrastructure or other customers:

  • Continuous excessive CPU usage
  • Excessive RAM consumption
  • Excessive disk I/O or IOPS
  • Abnormally high database load
  • Fork bombs or runaway processes
  • Unauthorized cryptocurrency mining
  • Excessive cron jobs
  • Artificial traffic generation
  • Using shared hosting primarily as backup storage
  • Using shared hosting as a public file-sharing platform
  • Bypassing plan or software limits
  • Activities causing network or service instability

The term “unlimited” does not mean infinite resources. Unlimited services remain subject to fair and reasonable usage.

BahariHost may throttle, isolate, restrict, suspend, or request an upgrade for services causing excessive resource usage.

11. Customer Conduct

Customers must communicate respectfully with BahariHost employees, administrators, support agents, contractors, and representatives.

The following conduct is prohibited:

  • Threatening staff
  • Harassing or repeatedly insulting staff
  • Using discriminatory or obscene language directed at staff
  • Blackmail or attempted intimidation
  • Publishing private staff information
  • Impersonating BahariHost employees
  • Bribing or attempting to manipulate staff
  • Repeated support-ticket spam
  • Deliberately disrupting support operations
  • Making knowingly fraudulent accusations
  • Attempting to compromise staff accounts or systems

BahariHost may issue a warning for minor misconduct. Serious or repeated misconduct may result in restricted support access, account suspension, service termination, or permanent refusal of future service.

BahariHost may immediately terminate services in cases involving credible threats, fraud, blackmail, violence, severe harassment, bribery, or attempts to compromise BahariHost systems or personnel.

Respectful criticism, genuine complaints, negative reviews, billing disputes, or refund requests will not be treated as misconduct.

12. Customer Content and Responsibility

Customers are solely responsible for all content and activities associated with their services.

Customers must ensure that:

  • They have the legal right to use and publish their content
  • Required licenses and permissions have been obtained
  • Their content complies with applicable law
  • Their users and customers comply with these Terms
  • Their applications and websites are secured
  • Abuse complaints are addressed promptly

BahariHost provides technical infrastructure and does not create, approve, control, or endorse customer content.

BahariHost will not be responsible for illegal or unauthorized activities independently performed by a customer or a user of the customer's service.

13. Managed and Unmanaged Services

Unless expressly advertised as managed, VPS, RDP, cloud server, and dedicated-server services are provided on an unmanaged basis.

For unmanaged services, the customer is responsible for:

  • Operating-system administration
  • Security hardening
  • Software installation
  • Updates and patches
  • Firewall configuration
  • Application deployment
  • Database administration
  • Backup management
  • Malware removal
  • Troubleshooting custom software
  • Monitoring server performance

BahariHost may provide reasonable guidance but is not obligated to manage an unmanaged service without a separate management agreement.

14. Backups and Customer Data

Unless a service explicitly includes managed backups, customers are responsible for maintaining current and independent backups of their data.

Any backup provided by BahariHost is an additional convenience and must not be treated as the customer's only backup.

BahariHost does not guarantee that:

  • Every file will be backed up
  • Every backup will be complete
  • A specific restore point will be available
  • Backup restoration will always succeed
  • Backups will remain available after service expiration or termination

Customers should maintain multiple backup copies in separate locations.

15. Domains and Third-Party Services

Domain registrations, domain renewals, domain transfers, software licenses, SSL certificates, control panels, payment gateways, and other third-party products are subject to the rules of their respective providers.

BahariHost cannot guarantee:

  • Domain availability before successful registration
  • Recovery of an expired domain
  • Continued availability of third-party software
  • Approval by an external registrar or license provider
  • Compatibility of every third-party product
  • Uninterrupted operation of third-party services

Customers are responsible for reviewing and complying with any applicable third-party terms.

16. Service Migration

BahariHost may offer free or paid migration depending on the purchased service, source platform, data size, and technical requirements.

Customers must:

  • Provide valid access credentials
  • Confirm that they are authorized to migrate the data
  • Maintain an independent backup before migration
  • Verify the migrated service before cancelling the previous provider

BahariHost does not guarantee that every file, email, database, DNS record, application, or configuration can be migrated without errors or interruption.

17. IP Addresses and Network Resources

IP addresses assigned with a service remain under the control of BahariHost or its network providers and are not owned by the customer.

BahariHost may replace, withdraw, reroute, or restrict an IP address due to:

  • Network restructuring
  • Abuse complaints
  • Provider requirements
  • Routing changes
  • Security incidents
  • IP-reputation issues
  • Technical requirements

Customers must not damage IP reputation through spam, phishing, fraud, scanning, attacks, or other prohibited activities.

18. DDoS Protection

DDoS protection is intended to reduce certain types of attacks but does not guarantee complete protection against every attack.

BahariHost may temporarily:

  • Filter traffic
  • Apply rate limits
  • Restrict ports
  • Isolate a service
  • Reroute traffic
  • Null-route an IP address
  • Suspend a targeted service

These actions may be taken where necessary to protect BahariHost infrastructure, network providers, or other customers.

Customers operating high-risk services must disclose the nature of their workload before purchasing.

19. Reseller Responsibility

Resellers are responsible for the activities and content of their own customers.

Resellers must:

  • Ensure downstream customers comply with these Terms
  • Respond to abuse complaints promptly
  • Maintain accurate customer records where required
  • Provide first-line support to their customers
  • Avoid misrepresenting BahariHost services
  • Prevent repeated abuse of shared infrastructure

BahariHost may suspend a reseller service where the reseller fails to address serious or repeated abuse by a downstream customer.

20. Service Availability and Maintenance

BahariHost aims to provide reliable services but cannot guarantee uninterrupted or error-free operation.

Service interruptions may occur due to:

  • Scheduled maintenance
  • Emergency maintenance
  • Hardware failure
  • Software failure
  • Network-provider outages
  • DDoS attacks
  • Data-center incidents
  • Power or connectivity failure
  • Security emergencies
  • Government or legal restrictions
  • Natural disasters
  • Events beyond BahariHost's reasonable control

Where practical, BahariHost will attempt to provide notice of scheduled maintenance and restore affected services as soon as reasonably possible.

Any uptime commitment or service credit will be governed by a separate Service-Level Agreement where applicable.

21. Suspension of Services

BahariHost may suspend, restrict, isolate, or disable a service where:

  • These Terms are violated
  • Payment is overdue
  • Fraud is suspected
  • Illegal activity is detected or reported
  • A security threat exists
  • Excessive resources are being consumed
  • The service affects other customers
  • The customer fails to respond to an urgent abuse notice
  • A valid legal or provider request is received
  • Customer conduct creates a serious operational risk

Where reasonable, BahariHost may provide notice and an opportunity to resolve the issue.

Immediate suspension may occur where urgent action is necessary to prevent fraud, illegal activity, security compromise, network damage, or harm to another person.

Suspension does not automatically extend the service period or cancel outstanding invoices.

22. Service Termination

BahariHost may terminate a service or account where:

  • A serious or repeated violation occurs
  • The service is used for illegal activity
  • Fraudulent payment is used
  • The customer repeatedly ignores abuse notices
  • Staff or administrators are seriously threatened or harassed
  • The customer attempts to compromise BahariHost systems
  • Continuing the service creates a legal, security, or infrastructure risk

When a service is terminated, access may be removed immediately and associated data may be deleted according to BahariHost's data-retention procedures.

Customers are responsible for maintaining backups before termination, cancellation, or expiration.

23. Fraud and Payment Disputes

BahariHost may investigate suspicious orders, payments, account activity, and identity information.

A fraudulent, false, or unauthorized payment dispute may result in:

  • Immediate suspension
  • Service termination
  • Restriction of future purchases
  • Submission of relevant records to the payment provider
  • Recovery of reasonable administrative or dispute costs

Customers are encouraged to contact BahariHost support before initiating a payment dispute.

Legitimate disputes made in good faith will be handled according to applicable payment-provider procedures and law.

25. Data Retention and Deletion

BahariHost may retain account, billing, service, and security information for operational, fraud-prevention, dispute-resolution, backup, or legal purposes.

After a service is expired, cancelled, suspended, or terminated:

  • Data may be retained temporarily
  • Access may be restricted
  • Data may be permanently deleted
  • Restoration may not be available
  • BahariHost is not obligated to retain data indefinitely

Customers must retrieve and back up their data before cancelling or allowing a service to expire.

26. Disclaimer of Warranties

BahariHost services are provided on an “as available” basis.

To the maximum extent permitted by applicable law, BahariHost does not guarantee that:

  • Services will always be uninterrupted
  • All software will be compatible
  • Every attack or security threat will be prevented
  • Customer applications will be free of errors
  • Data can always be recovered
  • Services will meet every specific business requirement
  • Third-party products will always remain available

No statement by an employee or support representative creates a warranty unless confirmed in an authorized written agreement.

27. Limitation of Liability

To the maximum extent permitted by applicable law, BahariHost will not be responsible for indirect, incidental, special, punitive, or consequential losses, including:

  • Loss of profit
  • Loss of business
  • Loss of customers
  • Loss of reputation
  • Loss of data
  • Missed opportunities
  • Third-party claims

Where BahariHost is legally liable, its total liability relating to an affected service will generally not exceed the amount paid by the customer for that service during the relevant billing period, unless applicable law requires otherwise.

28. Indemnification

Customers agree to indemnify and hold harmless BahariHost, Datacorelink, their employees, contractors, infrastructure providers, and representatives from reasonable claims, losses, penalties, or costs arising from:

  • Customer content
  • Customer activities
  • Violation of these Terms
  • Violation of applicable law
  • Infringement of third-party rights
  • Activities performed through the customer's account or service

This provision does not apply where a claim results directly from BahariHost's proven unlawful conduct or gross negligence.

29. Force Majeure

BahariHost will not be responsible for failure or delay caused by events beyond its reasonable control, including:

  • Natural disasters
  • Fire or flooding
  • War or civil unrest
  • Government restrictions
  • Internet or telecommunications failure
  • Data-center incidents
  • Power-grid failure
  • Large-scale cyberattacks
  • Supplier or network-provider failure
  • Labor disputes
  • Other force-majeure events

BahariHost will make reasonable efforts to restore affected services when possible.

30. Modification of Services

BahariHost may modify, replace, discontinue, relocate, or upgrade a service where reasonably necessary due to:

  • Technology changes
  • Security requirements
  • Supplier changes
  • Data-center changes
  • Licensing requirements
  • Legal or regulatory obligations
  • Product restructuring

Where a material change significantly affects an active paid service, BahariHost will attempt to provide reasonable notice or an appropriate alternative.

31. Changes to These Terms

BahariHost may update these Terms to reflect changes in services, technology, law, security practices, or business operations.

The latest version will be published on the BahariHost website with a revised update date.

Material changes may also be communicated through:

  • Email
  • Client-area notice
  • Support ticket
  • Service announcement

Continued use of BahariHost services after updated Terms become effective constitutes acceptance of the revised Terms.

32. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

The affected provision will be interpreted or modified only to the minimum extent necessary to make it valid and enforceable where permitted by law.

33. No Waiver

Failure by BahariHost to enforce any provision of these Terms does not waive its right to enforce that provision later.

Any waiver must be issued in writing by an authorized BahariHost representative.

34. Governing Law and Jurisdiction

These Terms are governed by the applicable laws of Bangladesh.

Any dispute that cannot be resolved through good-faith communication will be subject to the jurisdiction of the competent courts of Dhaka, Bangladesh, unless applicable law requires otherwise.

Customers are encouraged to contact BahariHost support and attempt an informal resolution before beginning formal legal proceedings.

36. Final Acceptance

By registering an account, placing an order, making a payment, renewing a service, or continuing to use BahariHost services, you acknowledge that:

  • You have read and understood these Terms
  • You agree to comply with all applicable rules and laws
  • You are responsible for your account, content, users, and activities
  • BahariHost may restrict, suspend, or terminate services that violate these Terms
  • Illegal or unauthorized activities performed by you or your users remain your responsibility
  • BahariHost provides infrastructure but does not accept responsibility for independent illegal activities performed by customers
